On the political status of the republic

Administrative Structure

Evdonia is a confederal presidential republic with executive, judicial and legislative functions, and, at founding, no sovereign territory (this may change based on our fortune). When the subject base of the state (be that the whole of Evdonia, a Non-Regional Commission, or a Regional Commission) falls under 5, the Officers of the General Secretary, a post which, at that subject base size, must include all citizens/subjects (unless they resign), discharge all functions of state - they are Justices of the Supreme Court of the relevant Commission, they are Members of Parliament, Members of the Legislative Assembly, Congresspeople, or whatever title their parliament may elect to assign them, as well as being the General Secretaries. This is called a Transitional Government, and it occurs because there are too few subjects to raise a parliament. It may occur in an NRC or in an RC, or it may occur across the whole republic.

Subjecthood is granted by action of the republican executive or, by letter patent of the republican executive, by a Commission which is confederate to the republic. This may occur by a publication in the Gazette under the person’s legal name in other states, or under a name requested by the subject (as with the initial subject), or under the name Alex Bloggs, which occurs when someone who is anonymous to the executive or wishes to remain anonymous for safety reasons.

The basic unit of confederation is a Commission, which has jurisdiction over a defined “area” (be it territory, an embassy, or something else that requires a separate legislature and judiciary, even if only separate in name (the General Secretariat of the Commission for Republic House, the administration of the extraterritorial small bungalow in Western Canada, is held by everyone who holds the General Secretariat of the republican Commission, subject to the limits of shorthold tenancy in the surrounding state)). A commission is created by letter patent of the republican executive, or by letter patent of the executive of a Commission authorized to create Commissions subject to its jurisdiction (most will be). Commissions may break from Evdonia if they are territorial (Regional), and the republic and its NRCs must recognise this. Commissions may be destroyed by letter patent if they have not adopted a constitution or if they have not sought to secede. The republic may be described as unitary for that reason.

Actions of the executive require consent of the legislature, which can be given in advance or can be given in arrears, or can be implied by the ex-officio MP nature of the OGS under transitional government. A Commission’s judiciary may issue an order requiring a letter patent or executive action to be issued; these letters or actions are effective backdated to when the orders occur, within the extent permissible by time, space, and outside factors.

A letter patent is a letter from a Commission establishing a privilege, or the existence, of a Commission subordinate to it, or a restriction on its own powers or a subordinate commission’s powers. It may amend the constitution until a letter patent is released detailing a permanent constitution.

Limits

Neither the republic nor a Commission is permitted to take any action or inaction to favour or disfavour any religion, ethnicity, sex or gender, or economic class over any other, unless such action is absolutely outside the republic/Commission’s power. Inaction to favour or disfavour a class may look like failing to set up a truth and reconciliation committee to redress a wrong done by the republic, a Commission, or a predecessor state towards the First Nations or Inuit, or other aboriginals of the lands presently known as the US or Canada, should they come under the control of a Commission or the republic. Inaction to disfavour may also include not ceding territory to the allodial control of an aboriginal-operated Commission, or forbidding it to secede from confederation if that is the will of its legislature and executive. It may also look like refusing to permit, within the practical limits of the republic or a Commission’s power and resources, somebody with a uterus (this would be a sex or gender class) to receive an abortion, should it be needed for their life, health or just because they don’t want to be burdened with pregnancy, or somebody who is transgender to change their name with the legal system or seek medical treatments.
